The art. 6 of Legislative Decree no. 201/22 provides, in paragraph 1, the distinction between regulation and management functions in the organizational structure of local authorities, establishing in the following paragraph 2, that the government bodies of the optimal territorial areas and the authorities specifically established for the regulation and control of local public services may not directly or indirectly participate in persons responsible for the management of the service, while this is permitted to the individual local authorities falling within the same ambit. For local entities, art. 33 a transitional regime to which a restrictive reading by the Court of Auditors and the AGCM is taking away its effectiveness.
