Questo matrimonio non s’ha da fare: né ora né mai? Riflessioni sul diritto islamico e le libertà matrimoniali

The Islamic well-known prohibition of marriage per disparitas cultus (iḫtilāf al-dīn) prevents a Muslim woman from marrying a man who does not profess the Islamic religion. The ban is accepted by the majority of Islamic countries and legislations and it falls within the principles of Islamic public order that can hardly be questioned. However, there is no shortage of exceptions and reforms implemented in such a delicate area, attesting on the one hand the 'resistance' of the šarīʿa and on the other the dynamism of Islamic societies and institutions that try to obey to šarīʿa while at the same time promoting a modern vision of the sacred law of Islam.
