On 8 October 2021, the Committee on the Rights of the Child adopted a
very important decision in the Sacchi et al. v Argentina, Brazil, France,
Germany and Turkey case, filed in 2019 by 16 young people from 12
countries, who had accused the aforementioned states of violating the
Convention on the Rights of the Child by causing and perpetuating the
climate crisis. Although the Committee declared the complaint inadmissible
for failure to exhaust domestic remedies, the decision contains interesting
statements in particular with regard to the notion of extraterritorial
jurisdiction, which make the ruling a precious tool in the fight against
climate change through so-called climate justice and may have significant
repercussions with respect both to future petitions before the CRC
Committee and to cases already pending before other international bodies or
domestic courts.
