abstract:
The "superimposition theory" means that a new system of heirs by quota was superimposed on the pre-Islamc agnatic customary law of inheritance. The ancient system was not abolished, but only modified. Having this theory been denied by some scholar, the paper wants to re-affirm it based on the most ancient sources.
