Immigrazione: il collegamento via skype con i genitori non limita i danni della lontananza, nota a Corte di Cassazione, sezione I civile; ordinanza 24 aprile 2019, n. 11274

Abstract:
Il contributo è un commento alla recente ordinanza della Corte di Cassazione, 24 aprile 2019, n. 11274, con cui il Supremo Collegio ha affrontato il tema dell’autorizzazione a permanere nel territorio nazionale, come disciplinato dall’art. 31 del t.u. immigra- zione, precisando che la norma non può essere interpretata in senso restrittivo, in quanto tutela il diritto del minore ad avere rapporti continuativi con entrambi i genitori anche in deroga alle altre disposizioni del decreto. La Corte ha altresì chiarito i limiti, rispetto allo sviluppo dei minori, dell’utilizzo dei programmi di comunicazione audio-video come Skype nel rapporto genitori-figli. A tal proposito si affronta il tema del superiore interesse del minore, del suo diritto all’amore e a crescere in una famiglia.
